Illinois Phase 5 & Community Associations.

Illinois entered Phase 5 of Governor Pritzker’s Restore Illinois Plan on Friday, June 11th, 2021. Under this phase, there are essentially no restrictions arising out of COVID-19.

We recommend that Associations begin to reconsider any policies that were put in place arising out of COVID-19.

Below are a few key points to consider:

1. Masks – there is currently no mask mandate imposed by the State of Illinois. Similarly, the City of Chicago’s requirements were lifted on May 18, 2021. The only applicable “mask mandate” is a City of Chicago Executive Order requiring individuals over the age of 2, who have not been vaccinated, and are able to medically tolerate it, wear a mask.

2. Amenity Spaces – There are no longer any federal, state, or local laws limiting use of common area spaces and amenities.

Notwithstanding the above, Boards may continue to impose rules and regulations arising out of COVID-19. It is also possible that these rule and regulations imposed by governmental authorities may quickly change. Every Association is different, and we encourage Boards to discuss these matters to decide what they believe is best for their community and its resident’s needs.
